Terms of Service

Last Updated: August 13, 2026

Welcome to [POPCORE TORONTO]. These Terms of Service govern your access to and use of our website, products, and services. Throughout these Terms, “we,” “us,” and “our” refer to [POPCORE TORONTO], and “you” refers to the website visitor or customer.

By visiting our website, creating an account, or placing an order, you agree to these Terms of Service and all policies referenced on our website. If you do not agree, please do not use our website or purchase our products.

1. Business Information

POPCORE TORONTO: [POPCORE TORONTO]

2. Eligibility

You must be at least the age of majority in your province or territory to place an order. Children may use our products only under the supervision of a parent, guardian, or responsible adult and in accordance with the product’s age recommendation and safety instructions.

You agree to provide accurate, current, and complete billing, shipping, and contact information when placing an order.

3. Products and Toy Safety

We make reasonable efforts to display accurate product descriptions, images, colours, dimensions, materials, age recommendations, warnings, availability, and prices.

Screen settings, lighting, manufacturing updates, or packaging changes may cause minor differences between an online image and the product received. These differences do not limit any rights available under applicable law or our Return Policy.

Customers and caregivers are responsible for:

  • Reviewing the recommended age range before purchase.

  • Reading and following all warnings and instructions.

  • Providing appropriate adult supervision.

  • Keeping small parts away from children under three years of age.

  • Inspecting toys before and during use.

  • Discontinuing use if a toy becomes damaged or presents a potential hazard.

We do not claim that Health Canada has certified or approved a product unless that statement is accurate and supported by appropriate documentation.

4. Prices and Currency

Unless otherwise stated, prices are displayed in Canadian dollars (CAD). Applicable taxes, shipping charges, discounts, and the final order total will be displayed before payment is submitted.

We may change product prices or promotions at any time. A price change will not affect an order that we have already accepted, except where correction is required because of an obvious pricing or technical error and permitted by law.

5. Orders and Acceptance

Your order is an offer to purchase products from us. An automated order confirmation acknowledges receipt of your order but does not necessarily mean that we have accepted it.

We reserve the right to refuse or cancel an order for legitimate reasons, including:

  • Product unavailability.

  • Incorrect pricing or product information.

  • Suspected fraud or unauthorized payment.

  • An invalid or incomplete delivery address.

  • Quantity limits.

  • A product-safety concern or recall.

  • A violation of these Terms.

If we cancel an order after payment has been collected, we will refund the cancelled amount to the original payment method.

6. Payment

You authorize us and our payment providers to charge the total shown at checkout to your selected payment method.

Payment-card information is processed by our payment service providers. We do not intentionally store complete payment-card numbers on our own systems.

If your payment is declined, reversed, disputed, or identified as unauthorized, we may suspend or cancel the order.

7. Shipping and Delivery

We currently ship to eligible addresses within Canada.

Estimated delivery is 3–5 business days after the order has been processed and shipped, unless a different estimate is displayed on the product or checkout page. Processing time, shipping charges, carrier information, delivery limitations, and possible delays are explained in our Shipping Policy.

Delivery estimates are not guaranteed where delays result from severe weather, public holidays, remote destinations, carrier disruptions, incorrect addresses, safety events, or other circumstances outside our reasonable control.

8. Returns and Refunds

Customers may request a return for any reason within 30 calendar days after delivery, subject to our Return Policy.

For a standard change-of-mind return, the customer is responsible for return shipping costs. We cover reasonable return shipping costs when an item arrives damaged, defective, materially different from its description, or incorrect.

Approved refunds are issued to the original payment method after the returned product is received and inspected, unless applicable law requires a different process.

Please read our Return Policy before sending a product back. Unauthorized returns may not be delivered to the correct return location.

9. Damaged, Defective, Incorrect, or Unsafe Products

If an item arrives damaged, defective, incorrect, incomplete, or potentially unsafe, stop using it and contact us promptly.

Please provide your order number, product name, explanation, and clear photographs or video when possible. We may offer a replacement, refund, return label, safety instructions, or another legally appropriate remedy.

Nothing in these Terms limits rights relating to unsafe products, recalls, statutory warranties, or other protections that cannot lawfully be excluded.

10. Product Recalls

We do not knowingly sell products subject to an active safety recall.

If we become aware of a recall or material safety concern affecting a product we sold, we may contact customers using the information associated with their orders and provide instructions regarding discontinuing use, returning, repairing, replacing, or disposing of the product.

Customers should immediately follow any recall or safety instructions.

11. Intellectual Property

All original website content—including our POPCORE TORONTO, logo, layout, photographs, graphics, text, and design—is owned by or licensed to [POPCORE TORONTO] and protected by applicable intellectual-property laws.

Third-party brand names and trademarks belong to their respective owners. Their appearance on a product page does not imply a partnership or endorsement unless clearly stated.

12. Prohibited Uses

You may not use our website:

  • For unlawful, fraudulent, or deceptive activity.

  • To violate intellectual-property or privacy rights.

  • To transmit malware or malicious code.

  • To interfere with website security or operation.

  • To collect personal information without authorization.

  • To place fraudulent orders or abuse promotions.

  • To submit false reviews or misleading information.

  • To resell products unlawfully or contrary to stated restrictions.

We may restrict access or cancel affected orders if prohibited activity is detected.

13. Third-Party Services and Links

Our website may use or link to third-party services, including payment processors, carriers, analytics providers, or social platforms. We are not responsible for an unrelated third party’s website, content, availability, or privacy practices.

Your use of a third-party service may be subject to that provider’s separate terms and policies.

14. Disclaimer

We make reasonable efforts to keep the website accurate and available. However, the website may occasionally contain typographical errors, experience maintenance, or become temporarily unavailable.

Except where prohibited by law, the website and services are provided on an “as available” basis. We do not exclude warranties, remedies, or consumer rights that cannot legally be excluded.

15. Limitation of Liability

To the maximum extent permitted by applicable law, [POPCORE TORONTO] will not be liable for indirect, incidental, special, or consequential losses arising from the use of the website or products.

This limitation does not apply where liability cannot lawfully be limited, including certain claims involving personal injury, gross negligence, intentional misconduct, unsafe consumer products, or mandatory consumer rights.

16. Indemnification

To the extent permitted by law, you agree to indemnify [POPCORE TORONTO] against claims and reasonable expenses arising from your unlawful use of the website, violation of these Terms, or infringement of another person’s rights.

17. Privacy

Our collection, use, retention, and disclosure of personal information are described in our Privacy Policy.

18. Changes to These Terms

We may update these Terms to reflect operational, legal, or regulatory changes. The updated version will be posted on this page with a revised “Last Updated” date.

Changes will not retroactively reduce rights associated with an order already placed unless permitted by law.

19. Governing Law

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without limiting mandatory consumer protections available in another Canadian province or territory.
